Law division notifies appointment of CCP’s Appellate Tribunal chairman

ISLAMABAD: Ministry of Law and Justice has notified the appointment of Justice Retd. Mazhar Alam Khan Miankhel,  former Chief Justice of Peshawar High Court and former judge of the Supreme Court, as the Chairman of the Competition Appellate Tribunal at the Competition Commission of Pakistan (CCP).

As per the notification, in exercise of the power conferred by section 43 of Competition Appellate Act 2010, the federal government has appointed Justice Miankhel as chairman till attaining the age of sixty eight 13/07/2025 with effect from the date of assumption of charge of the post.

However, the press release published by the CCP says that the new chairman has been appointed for a term of three years. The federal cabinet had approved this appointment in its meeting held on Wednesday.

The Competition Appellate Tribunal has 212 cases pending its hearing. Since the Tribunal has not been functional for 7.5 years out of last 10 years, the undertakings have sought alternate remedy from High Courts. The number of such petitions in High Courts across the country is 140.

The delays in deciding upon appeals had adverse impact on implementing essential CCP orders across various sectors, including sugar, cement, fertilizer, telecom, banks, and consumer goods.

According to CCP’s press release, the Tribunal will be hearing the sugar cartel case, wherein the CCP has imposed a substantial Rs 44 billion penalty on the Pakistan Sugar Mills Association and its member sugar mills.
