CDA warns housing society over unauthorised construction

ISLAMABAD: The Capital Development Authority (CDA) has issued a notice to the Roshan Pakistan Housing Society, warning that unauthorised construction in its E-16 Zone 2 project could face demolition unless regulatory requirements were fully met.
The civic agency said that restoration of the society’s cancelled no-objection certificate (NOC) and layout plan would only be considered after complete compliance with legal and procedural formalities. These include verification of land records, issuance of public notices inviting objections, submission of required undertakings, and payment of scrutiny fees along with a restoration charge of 2,000 rupees per kanal.
In its notice, the CDA said any construction carried out in violation of approved plans or regulations is illegal and would not be protected under the law. It cited rulings by the Islamabad High Court and the Supreme Court of Pakistan affirming the authority’s exclusive jurisdiction over approvals and enforcement within the capital.
The housing society has been directed to submit all required documentation within seven days, failing which its restoration request will be treated as rejected.
The CDA said enforcement responsibility also extends to the local administration, including the Chief Commissioner, Deputy Commissioner, police and magistrates.
The authority further instructed that all funds collected from allottees must be deposited within three months and that no construction activity should proceed without prior approval.
Any alteration of public utility areas — such as parks, mosques, schools or playgrounds — could result in cancellation of the layout plan and possible takeover of assets and bank accounts, the notice said.
The CDA said future plot allotments must strictly follow approved layouts, with housing societies required to submit undertakings ensuring no deviations or land-use conversions.
It said that enforcement actions would be carried out under Section 49-C of the CDA Ordinance 1960 and relevant zoning regulations to ensure compliance.
