SC orders CDA to return IWMB’s premises in Margalla Hills

ISLAMABAD: The Supreme Court has directed the Capital Development Authority (CDA) to return premises previously occupied by a wildlife treatment center Islamabad Wildlife Management Board (IWMB) on Trail 5 within the Margalla Hills National Park.

The decision, delivered by Chief Justice Qazi Faez Isa, came after deliberations regarding the legality of the center’s eviction and the removal of wildlife equipment.

Wildlife under siege or bureaucracy trying to firefight?

During the proceedings, Chief Justice Isa inquired about the national park’s status, to which the CDA lawyer confirmed its designation as a declared national park since 1980. The court emphasised the need to uphold fundamental rights, including the right to a dignified life, and criticised the CDA’s conduct as inappropriate.

The Wildlife Board, whose offices were affected by the eviction, highlighted the importance of reinstating equipment to address potential threats to wildlife within the park. Chief Justice Isa underscored the significance of maintaining essential facilities for wildlife conservation and suggested utilising CDA rest houses for public benefit.

Furthermore, the court ordered the disclosure of all CDA properties within Margalla Hills National Park and requested photographic evidence of rest houses for scrutiny. Additionally, a notice was issued to the Attorney General to ensure compliance with the court’s directives.

The ruling signifies a victory for wildlife conservation efforts and underscores the judiciary’s commitment to upholding environmental protection and citizens’ rights.
