WEB DESK: The United States has formally removed the United Nations Special Rapporteur, Francesca Albanese, from its sanctions list, according to an official statement issued by the US Department of the Treasury.
The sudden policy reversal arrives exactly a week after a federal judge intervened to temporarily block the enforcement of the restrictions, according to Al Jazeera.
The court ruled that the punitive measures enacted against the independent diplomat were highly likely to have violated her constitutional rights to free speech, following her fierce and high-profile criticism of Israel’s military campaign and ongoing humanitarian policies within the Gaza Strip.
Legal challenge over constitutional rights
The legal dispute escalated rapidly when the federal bench subjected the administrative blacklisting to rigorous judicial review.
The presiding judge determined that applying financial and travel sanctions against an active UN official for expressing political viewpoints set a problematic precedent, significantly impeding internationally protected speech.
Attorneys representing Albanese had argued successfully that the restrictions served as a direct retaliatory mechanism aimed at suppressing critical oversight regarding state conduct in conflict zones.
Legal analysts noted that the Treasury’s compliance with the court’s temporary injunction indicates an acknowledgement of the severe legal vulnerabilities inherent in using domestic sanctions frameworks to penalise global human rights monitors.
By lifting the sanctions ahead of further formal litigation, Washington avoids a protracted legal showdown regarding the boundaries of the First Amendment when applied to international dignitaries operating within American jurisdiction.
International friction and administrative review
Ms Albanese’s tenure as the UN Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967 has been marked by acute friction with both Washington and Tel Aviv.
Her outspoken assessments concerning the catastrophic humanitarian crisis in Gaza have frequently drawn condemnation from American officials, who previously labelled her rhetoric as heavily biased.
However, the decision to weaponise Treasury Department sanctions against her generated widespread pushback from international legal bodies and civil liberties organisations worldwide.
With her removal from the Office of Foreign Assets Control (OFAC) sanctions list, Ms Albanese regains full access to standard diplomatic operations and financial channels necessary to execute her UN mandate.
The Treasury Department has declined to provide extensive commentary on the administrative delisting, stating only that the decision aligns with current legal determinations and ongoing diplomatic reviews regarding international personnel.
