Defence ministry challenges SC’s verdict on civilian trials in military courts

ISLAMABAD: The Ministry of Defense has challenged the Supreme Court’s decision to suspend the trials of civilians in military courts.
The ministry has filed a request to declare the Supreme Court’s decision [of not conducting trial of individuals accused of attacking army installations in military courts] as null and void.
A series of requests have been put forth by the Ministry of Defense in the appeal, urging the restoration of repealed provisions of the Official Secrets Act. Additionally, the Ministry is seeking the reinstatement of Section 59(4) of the Army Act.

Furthermore, the Defense Ministry has petitioned for an injunction to prevent the cessation of trials in military courts until a final decision is reached on the pending appeals. The ministry contends that stopping these trials prematurely could have severe consequences for national security.
The appeal also states that the judgements on petitions presented before a five-member bench of the Supreme Court be declared null and void as well, since they were not tried in military courts.
The ministry argues that the repeal of provisions in the Army and Official Secrets Act poses a significant risk, potentially causing irreparable damage to the country.
