Justice Mansoor Ali Shah refuses to sit in benches formed under amended Practice and Procedure Act

ISLAMABAD: Justice Mansoor Ali Shah has written another letter to Chief Justice Qazi Faez Isa. This time he has recused himself from special or larger benches, until the full bench hears the amendment ordinance case.

The letter refers to the benches formed by the committee that came into existence after amendments to the Supreme Court Practice and Procedure Act 2023 through a presidential ordinance. The presidential ordinance was issued in September 2024.

As per sources, the letter was written to the Chief Justice as the head of the Practice and Procedure Committee, on October 23 (Wednesday).

Justice Mansoor also took issue with the 26th constitutional amendment, which also resulted in superseding Justice Mansoor as the chief justice. His statement reads, “I will not be a part of the special bench until the full court sits on the amendment ordinance”.

The letter also quoted Sir Thomas More, as Justice Mansoor penned, “We often forget, when in power, that people of this country are watching our actions, and that history never forgives”.
