LHC suspends ‘No helmet, no petrol’ notification

LAHORE: The Lahore High Court (LHC) on Friday suspended the directive that prohibited the sale of petrol to motorcyclists without helmets, deeming it a violation of fundamental rights.
Justice Raheel Kamran Sheikh of the Lahore High Court presided over the case pertaining to this ban.
As per the notification issued by the Deputy Commissioner, pumps will be banned from dispensing petrol to motorcyclists without helmets. In this regard, Deputy Commissioner Lahore said that motorcycle riders without helmets will not be allowed to give petrol under any circumstances and that petrol stations dispensing fuel to such motorcyclists would face fines..
The petitioner appealed to the court, asserting that ban has been imposed in Lahore and it is causing a great inconvenience.
Union protests against PIA privatisation
The high court expressed significant concern regarding the implementation of this ban via a simple notification. It raised questions about the legality of such a directive and underscored the paramount importance of safeguarding citizens’ fundamental rights in an impartial and fair manner.
The court remarked, “Fundamental rights cannot be withheld or restricted without adherence to proper legal procedures.”
Consequently, the court has suspended the aforementioned notification and issued a formal notice to the federal government and other pertinent stakeholders to seek their input on this matter.
