Pervez Elahi’s contempt petition inadmissible: IHC

ISLAMABAD: In a recent development, the Islamabad High Court (IHC) has declared Pervez Elahi’s contempt petition inadmissible. The court issued its judgment regarding the petition filed by Pakistan Tehreek-e-Insaf (PTI) President Pervez Elahi against his arrest.
The central issue of contention revolved around the release order related to Pervez Elahi in the 3MPO case. The IHC clarified that the order pertained solely to his release in the 3MPO case and did not encompass any prohibition against his potential re-arrest in another case.
During the proceedings, Justice Tariq Mehmood Jahangiri inquired of the petitioner’s lawyer, “Was Pervez Elahi not released?” The lawyer responded by asserting that Elahi was indeed arrested near the police lines shortly after his release.

The court emphasized the crucial distinction between refraining from releasing Pervez Elahi and re-arresting him in a separate case. It highlighted that not complying with the release order in the 3MPO case would constitute contempt of court.
The petitioner’s lawyer referenced an order from the Lahore High Court (LHC), which allegedly directed against the arrest of Pervez Elahi in any case. However, Justice Jahangiri pointed out, “Then the contempt of court application will be made in Lahore High Court, as there is no such order from this court.”
The IHC ruling stipulated that Pervez Elahi should be released if he was not wanted in any other case. In the event of his arrest in another case, the matter should be addressed by the relevant trial court, as per the IHC’s decision.
Addressing the lawyer, Justice Jahangiri further commented, “Pervez Elahi was sitting with you in the car. How was the order violated when Parvez Elahi was released?” Consequently, Pervez Elahi has now been remanded by the relevant court, Justice Jahangiri concluded.
