SC adjourns Article 63A hearing after Justice Muneeb’s no-show

ISLAMABAD: The Supreme Court begins hearing on the Article 63A revision plea today.
A five-member bench, led by Chief Justice Qazi Faez Isa, is overseeing the proceedings. The case, which could have significant political and constitutional implications, also includes Justices Aminuddin Khan, Jamal Khan Mandokhail, and Mazhar Alam Miankhel as part of the bench.
However, there was an unexpected development during the session when Justice Muneeb Akhtar did not appear in the courtroom. His absence was marked by the vacancy of his seat, raising speculation within the court.
According to Chief Justice Isa, a letter had been received from Justice Akhtar earlier, but the contents of the letter remained undisclosed, and it was noted that Justice Akhtar had not personally addressed any of the justices.
Justice Muneeb Akhtar has heard these cases, he was also present in the tea room, the Chief Justice said, adding that it was his choice not to attend today’s hearing.
“We will hear this review case again tomorrow. Hope that Justice Muneeb will join us then”, CJ Isa said.
“I think Justice Muneeb Akhtar should join the bench,” Additional Attorney General concurred.
Senator Ali Zafar came to the rostrum and said that he wanted to discuss an issue. “When one judge does not appear in the committee, two judges cannot decide on it” Zafar said, adding that if the committee is not complete then the full court should decide on the matter.
To this the Chief Justice responded, “It is a judge’s job description to hear cases”. Chief Justice”.
The Supreme Court adjourned the hearing till tomorrow.
Chief Justice Isa said that the committee will be reconvened. “If Justice Muneeb Akhtar does not join the bench, then a new bench will be formed. We will appoint a new judge in this case,” CJ Isa said.
