SC issues notices to channels that aired Vawda, Kamal press conferences

ISLAMABAD: The Supreme Court held hearing of the contempt of court case involving Faisal Vawda and Mustafa Kamal.

TV channels were directed to submit their replies within two weeks, while Senator Faisal Vawda was given one week to provide his response. Pakistan Electronic Media Regulatory Authority (PEMRA) was tasked with issuing notices to channels broadcasting press conferences related to the case.

In a subsequent appearance in the Supreme Court, Faisal Vawda and Muttahida Qaumi Movement (MQM) leader Mustafa Kamal were present, where Mustafa Kamal’s request for pardon was read out by lawyer Farogh Naseem.

Chief Justice of Pakistan (CJP) Qazi Faez Isa inquired about the mention of “Riba” in the application, seeking clarification on its relevance. Discussions ensued regarding the accidental nature of Mustafa Kamal’s press conference and the forgivability of such actions.

Throughout the proceedings, emphasis was placed on the importance of respect for both Parliament and the judiciary. Concerns were raised regarding the burden on parliamentarians when speaking against constitutional institutions and the need for thoughtful speech.

Additionally, discussions delved into the regulations of PEMRA regarding reporting court proceedings and actions against contemptuous language. CJP Isa expressed frustration over insults directed towards him and emphasised the importance of accountability.

CJP said, “I did not say anything about all the insults that were directed at me. Notice was taken when they targeted the court.” With emphasis, he added, “They post from anonymous [social media] accounts. If you have so much bravery, come to the forefront.”

During the proceedings, the script of Faisal Vawda’s press conference was scrutinised, with concerns raised about its content. Questions arose about the relevance of such press conferences to the judiciary and whether Parliament should address such matters.

The President of the Supreme Court Bar Association disputed instructions regarding PEMRA court reporting and advocated for a check system to ensure compliance. The Chief Justice expressed interest in holding channels accountable for their editorial policies, while the Attorney General emphasized the importance of constructive criticism.

The Supreme Court said that 34 channels had broadcasted Faisal Vawda’s press conference, while Mustafa Kamal’s had been covered by 28 channels. The Court issued notices to all channels that had aired either press conference.

The hearing has been adjourned until June 28.
