SC’s marriage law ruling violates Shariah, declares CII

ISLAMABAD: The Council of Islamic Ideology (CII) has declared it un-Islamic to give the first wife the right to annul the marriage contract without permission.

The council met on Thursday and Friday, presided over by CII Chairman Dr Raghib Hussain Naeemi.

This particular declaration came when the meeting discussed the Supreme Court’s decision given on October 23, 2024, in a case related to a marriage dispute and the violation of Muslim Family Laws Ordinance 1961.

It was discussed in the meeting that the Muslim Family Law of 1961 was against the principles of Shariah, and the two options given for the dissolution of a marriage are talaq and khula.

The CII meeting reiterated that males do not need the permission of the existing wife or wives for subsequent marriages as per the Shariah principles, adding that the males can enter into four marriages at one time, without being answerable to anyone including wives.

On the topic of marriage laws, CII also suggested to make tests for thalassemia and infectious diseases an optional part of the marriage contract before marriage.

Revised timings announced for schools after Eid

During the meeting, the CII also discussed Shariah regulations on medical treatments and said that kidney and liver transplantation is permissible if the donor’s life is not at risk. The final decision on the establishment of a human milk bank has been postponed.
