Toshakhana 2 case: IHC refuses to transfer acquittal plea to another bench

ISLAMABAD: The Islamabad High Court has rejected a request by the counsels of Imran Khan and Bushra Bibi for the transfer of the acquittal plea in Toshakhana 2 case to another bench.

Justice Raja Inam Amin Minhas was hearing the Toshakhana 2 Case on Thursday. The counsel for the PTI chairman requested a stay order on the trial proceedings.

The court stated, “There is no judicial precedent for staying criminal proceedings at this stage. Let the other party appear, and we will hear both sides,” remarked Justice Minhas.

Justice Minhas further added, “We will issue notices on your application and hear the other party too.”

The lawyers representing the PTI chairman and Bushra Bibi requested transferring the case to another bench. They argued that Justice Miangul Hassan Aurangzeb had already heard five petitions related to this matter.

“It would be appropriate for this court to send the acquittal pleas back to the same court,” the lawyer suggested.

No commission, no fourth round of talks: PTI

In response, Justice Minhas remarked, “Those were bail petitions; this is a separate matter. This court will hear the case. Please present your arguments on its merits.”

Barrister Salman Safdar requested that the case be scheduled for hearing on January 27. However, Justice Minhas responded, “It’s not possible for me on Monday.”

When the lawyer suggested Tuesday instead, the court staff proposed February 4 for the next hearing.

“That’s a gap of two weeks, which defeats the purpose,” said Barrister Safdar.

The hearing was eventually adjourned to January 28.
