PTI Chief’s lawyers claim unconsented Adiala jail transfer and limited facilities

ISLAMABAD: A lawyer representing Pakistan Tehreek-i-Insaf (PTI) Chariman said on Thursday that the former prime minister was moved from Attock Jail to Adiala Jail without his consent.

According to Dawn.com, Advocate Shiraz Ranjha informed the Judge of the Special Court (Official Secrets Act) that while they could easily meet PTI Chief at Attock Jail, the situation was different at Adiala.

The application before the Special Court sought directions to the Adiala jail superintendent to provide a telephone facility to the ex-premier, allowing him to call his sons.

Previously, a similar request had been rejected by Attock jail administration, citing restrictions for convicts under the Official Secrets Act.

Furthermore, Advocate Ranjha argued that Attock jail offered a better environment than the crowded Adiala jail. He said that jail rules restricting communication typically apply to convicted individuals, and as PTI Chief is an under-trial prisoner, he should have access to such facilities.

He urged Judge Abual Hasnat Zulqarnain to issue a directive for telephone facilities and other entitlements for PTI Chief as a former prime minister.

Earlier, during a hearing at Attock jail on September 26, PTI chief had expressed his preference to stay at Attock Jail, citing his adjustment to life there. He mentioned he would ask his lawyers to withdraw the plea for a transfer to Adiala.

In a separate development, Chief Justice of Islamabad High Court (IHC), Justice Aamer Farooq, issued a notice to the Adiala Jail administration on a petition filed by PTI Chief’s wife, Bushra Bibi, seeking proper security and facilities for her husband.

Advocate Sardar Latif Khan Khosa argued that PTI Chief’s detention conditions were subpar, and the court should allow homemade food for him. The petition expressed concerns about potential poisoning and sought the court’s directive for exercise and walking facilities within the jail premises.

In another legal move, PTI Chief’s counsel Khosa filed an application to amend the appeal against his client’s conviction in the Toshakhana case.

The application sought to implead the state as a respondent in the appeal and requested the court to set aside the conviction and disqualification. The appeal also sought suspension of the verdict until the final adjudication.
