Imaan Mazari, Hadi Ali Chattha sent to jail on judicial remand after rearrest

Lawyers Imaan Mazari and her husband, Hadi Ali Chattha, who were rearrested shortly after the Supreme Court ordered their release, have been sent to jail on judicial remand by an anti-terrorism court.

Anti-Terrorism Court Judge Abul Hasnat Muhammad Zulqarnain heard the case in which police sought a 30-day physical remand of the two lawyers.

The court rejected the police request for physical remand and sent Imaan Mazari and Hadi Ali Chattha to jail on judicial remand.

Islamabad Police later took the couple back to Adiala Jail.

Former federal minister Shireen Mazari said in a statement on X that both of them were taken into custody from inside Adiala Jail while their release paperwork was still being completed.

They actually took them from inside Adiala because we had not yet gone to get them released as paper work was not complete! Once again totally illegal to take somebody from inside the jail in this manner but then there has never been due process observed for Imaan and Hadi. https://t.co/VaizYeTkyf

“They actually took them from inside Adiala because we had not yet gone to get them released as the paperwork was not complete!” she said.

Mazari further described the move as “totally illegal”, saying the couple were taken from inside the jail despite their release process being incomplete.

“Once again, totally illegal to take somebody from inside the jail in this manner, but then there has never been due process observed for Imaan and Hadi,” she added.

A case has been registered against the two at Kohsar Police Station. The case includes charges related to an alleged anti-state narrative, incitement and interference in official duties, according to police sources.

Supreme Court had ordered their release

Earlier on Thursday, the Supreme Court suspended the sentences of Imaan Mazari and Hadi Ali Chattha and ordered their release on bail until the Islamabad High Court (IHC) gives its final verdict in the case.

A two-member Supreme Court (SC) bench comprising Justice Naeem Akhtar Afghan and Justice Ishtiaq Ibrahim granted bail to the couple against surety bonds of Rs200,000 each.

The court ordered that the relief of sentence suspension would remain in place until the IHC ‘s final decision.

Earlier, an Islamabad district and sessions court had sentenced Imaan Mazari and Hadi Ali Chattha to 17 years in prison each on January 24 in a case related to their social media posts.

The sentences were handed down under various provisions of the Prevention of Electronic Crimes Act (PECA).

Following the SC’s order, the two were expected to be released from Adiala Jail. However, they were taken into custody again before their release in connection with another case and later produced before the anti-terrorism court.

New case after rearrest

After their rearrest, the couple was produced before the anti-terrorism court, where police sought their 30-day physical remand.

The court rejected the request and sent both Imaan Mazari and Hadi Ali Chattha to jail on judicial remand.

The SC’s order suspending their sentences and granting them bail remains in place, while proceedings in the separate Kohsar Police Station case will continue independently.
