Reference filed against LHC Justice Shams Mehmood Mirza

LAHORE: A reference has been filed in the Supreme Judicial Council (SJC) seeking the removal of Lahore High Court Justice Shams Mehmood Mirza under article 209 of the constitution.

Assistant Attorney General Shiraz Zaka filed the reference.

A case between a private company and the Ministry of Petroleum, regarding a petroleum levy amounting to Rs. 40.1 crore, has been under trial in Justice Shams Mehmood Mirza’s court for the past seven years.

The reference alleges that Justice Mirza extends the stay order granted to the petitioner during every hearing. According to the reference, the case has been scheduled for hearing three times over the past one and a half years.

The reference accuses Justice Shams Mehmood Mirza of deliberately favouring the petitioner over the past seven years.

The reference states that the inquiry being conducted by the FIA has been halted due to Justice Mirza’s stay order.

Following the 26th Amendment, a judge can be removed upon proving incompetence, the reference argues.

The Islamabad High Court has issued a written order for hearing petitions seeking the acquittal of PTI founder and Bushra Bibi.

The court has issued a pre-admission notice to the FIA for January 28.

Justice Raja Inam Amin Minhas of the Islamabad High Court has issued the written order.
