SC, LHC justices advocate arbitration before court trials at IBA Karachi

“Nearly, 2.5 million cases are victims of our delay. Session courts have the most burden of cases,” Supreme Court Justice Mansoor Ali Shah said this while talking about the lag in cases. “With the change in people’s behavior, there is a need to make them aware [of arbitration],” he added.
Justice Mansoor was addressing an event of the Malaysian International Mediation Center, held at Institute of Business Administration (IBA), Karachi today. Dr Fareed, Head of Malaysian International Mediation Center, welcomed Justice Mansoor, praising him as, “the founder of mediation in Pakistan.” The center, now operational at IBA Karachi, hosted an event today to mark its launch.

Justice Mansoor commended the center and IBA for starting work on arbitration. He said, “In any case of disagreement, both the parties should first settle their issues themselves. If the parties fail to resolve the matter, then you should approach the mediation institutions.”
He said that the practically speaking, people bring even minor issues to courts. “[Arbitration] is a forum where you can resolve issues through table talk,” Justice Mansoor said.
JUSTICE JAWAD HASSAN’S SPEECH
Lahore High Court (LHC) Justice Jawad Hassan also spoke at the event. He said, “This institution was established to reduce the delay and burden of cases in Pakistan. Now we have to understand that to resolve cases pending for years, we have to refer to the arbitration institution.”
He added, “Now the judges of the Supreme Court also give instructions to the parties to refer to this direction.”

Meanwhile, the Supreme Court committee has announced the nomination of Tanzila Sabahat nominated as Law and Justice Commission Secretary.

Tanzila Sabahat has been appointed as Secretary of Law and Justice Commission on deputation for one year.
