Azam Khan’s death: Is KP cabinet dissolved?

ISLAMABAD: The passing of Caretaker Chief Minister Azam Khan has triggered a wave of constitutional transitions in Khyber Pakhtunkhwa (KP).

 According to former Secretary of the Election Commission of Pakistan (ECP), Kanwar Dilshad, in accordance with legal provisions, the provincial cabinet has been dissolved following Khan’s death.

Dilshad emphasized that, pending the appointment of a new Chief Minister, all executive powers have been delegated to KP Governor Ghulam Ali.

Given the absence of a provincial assembly, the responsibility of determining the next course of action falls on the Senate. Dilshad clarified that within the Senate, both the Leader of the House and the Leader of the Opposition will play pivotal roles.

To navigate this transitional period, a six-member committee, comprising three government and three opposition representatives, will be formed. This committee will be tasked with selecting a nominee for the position of KP Chief Minister. In the event of a deadlock, the matter will be escalated to the election commission, which is mandated to provide a decision within 48 hours, according to Dilshad.

Citing Article 224 of the Constitution, Dilshad underscored that a decision must be reached within a week. During this interim period, Governor Ghulam Ali will wield executive authority, overseeing the administrative affairs of the province.

The demise of Azam Khan, the Caretaker Chief Minister, was confirmed on Saturday morning. Sources from the Rehman Medical Institute, Peshawar, reported that Khan was transferred to a private hospital on Friday night when his health took a downturn.
