Toshakhana case: Trial court can’t adjudicate before IHC verdict, rules SC

ISLAMABAD: Supreme Court of Pakistan has said trial court cannot decide the Toshakhana case against former prime minister and Pakistan Tehreek-i-Insaf (PTI) Chairman till Islamabad High Court (IHC) announces a final verdict into a set of petitions filed by PTI chief.

A three-member SC bench headed by Justice Yahya Afridi, and comprising of Justice Musarat Hilali and Justice Hasan Azhar Rizvi announced the order.

During the proceedings, counsel for PTI chief Khawaja Haris told the bench that the decision on plea to transfer the case has been reserved by IHC and that the “trial court cannot proceed with the matter till his request is decided by the high court.”

The apex court said the Election Commission of Pakistan (ECP) has also admitted that the trial court cannot make a final decision until an IHC decision.

In its remarks, the SC expressed that both the high court and the trial court should uphold the spirit of the law throughout the proceedings.

The court acknowledged that the request to transfer the case to another court is still pending before the high court.

Earlier, the Supreme Court had constituted a fresh three-member bench to preside over the Toshakhana case against former Prime Minister and Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan.

Notably, Justice Hasan Azhar Rizvi has replaced Justice Mazahir Ali Naqvi in the bench.

During the previous hearing, it was announced that the next hearing would be scheduled with an available bench.
